1. About these terms
This website is operated by Psycho-T. Throughout these Terms, “we”, “us” and “our” refer to Psycho-T.
These Terms of Service apply when you browse our website, create an account, place an order or otherwise use our services. By using this website, you agree to these Terms, our Privacy Policy and our Return and Refund Policy.
If you do not agree to these Terms, please do not use our website.
2. Eligibility and account information
You must be legally capable of entering into a contract to place an order.
You agree to provide accurate, current and complete billing, delivery and contact information. You are responsible for protecting your account credentials and for activity conducted through your account.
3. Products
We make reasonable efforts to describe and display our products accurately. The appearance of colours may vary depending on your screen and device settings.
Psycho-T garments are made to order. Minor variations in garment colour, mineral-wash finish, print colour, print placement and production batches can occur. These variations are part of the production process and do not ordinarily constitute a fault unless the product is materially different from its description or does not meet an applicable consumer guarantee.
Measurements are supplied as a guide. Please review the relevant size guide before ordering.
We may update product descriptions, prices or availability and may discontinue a product without notice. Changes will not affect an order that we have already accepted unless we contact you and agree on an appropriate resolution.
4. Orders
Submitting an order is an offer to purchase from us. An order is accepted when we confirm it and successfully process payment.
We may decline or cancel an order where reasonably necessary, including because of suspected fraud, payment failure, incorrect pricing, product unavailability or an inability to fulfil the order. If we cancel an order after payment, we will provide an appropriate refund.
Please check the product, size, colour, quantity and delivery information carefully before submitting your order.
Because production can begin shortly after an order is placed, changes and cancellations are not guaranteed. Contact hello@psycho-t.com.au immediately if you need to request a change or cancellation. Once production has begun, we may be unable to change or cancel the order.
5. Prices and payment
Prices are displayed in Australian dollars unless otherwise stated.
The price payable is the price shown at checkout when the order is placed. Shipping, taxes, duties or other applicable charges will be displayed or described where relevant.
You confirm that you are authorised to use the payment method supplied and that the billing information you provide is accurate.
We may correct genuine pricing or listing errors. If an error affects an order you have placed, we will contact you and provide the option of proceeding at the correct price or receiving a refund.
6. Shipping and delivery
Psycho-T products are made to order, so production time applies before shipment.
Delivery dates and transit times are estimates rather than guarantees. Delivery can be affected by production requirements, carriers, customs, public holidays, weather and other circumstances outside our reasonable control.
Customers are responsible for supplying a complete and accurate delivery address. Contact us immediately if an address needs to be corrected. Once an order has entered production or shipment, a change might not be possible and additional delivery costs may apply.
Nothing in this section excludes any rights or remedies available under the Australian Consumer Law or other applicable consumer laws.
7. Returns and refunds
Returns, refunds, replacements and cancellations are handled in accordance with our Return and Refund Policy:

Because our garments are made to order, we do not offer returns or exchanges solely for change of mind, an incorrect size selection or an incorrect address entered by the customer.
This does not affect your rights when a product is faulty, damaged, incorrectly supplied, materially different from its description or otherwise fails to meet an applicable consumer guarantee.
8. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where liability can lawfully be limited, it will be limited only to the extent permitted by law.
9. Intellectual property
Unless otherwise stated, the Psycho-T name, branding, logos, artwork, designs, photographs, text and other website content are owned by or licensed to Psycho-T and are protected by Australian and international intellectual-property laws.
You may use this website for personal, non-commercial purposes. You must not reproduce, modify, distribute, sell, publish or commercially exploit our content without prior written permission.
10. Acceptable use
You must not use our website or services:
• For an unlawful, fraudulent or malicious purpose
• To infringe another person’s rights
• To introduce viruses, malware or harmful code
• To interfere with the website’s security or operation
• To collect personal information without authorisation
• To impersonate another person or provide misleading information
• To scrape, copy or commercially exploit website content without permission
We may restrict or terminate access where we reasonably believe these Terms have been breached.
11. Third-party services and links
Our store is hosted by Shopify. Shopify provides the ecommerce platform that enables us to offer products and services to you, but purchases from this store are made directly from Psycho-T.
Our website may use or link to services provided by payment processors, delivery providers and other third parties. Their own terms and privacy practices may apply when you use those services.
We are not responsible for third-party websites that we do not control.

Information may also be processed by Shopify and other service providers necessary to operate the store, process payments and fulfil orders.
13. Accuracy and availability
We may correct errors or omissions in product descriptions, pricing, promotions, availability, shipping charges or other website content.
We do not guarantee that the website will always be uninterrupted or error-free. We may suspend or modify parts of the website for maintenance, security or operational reasons.
14. Limitation of liability
To the maximum extent permitted by law, Psycho-T is not liable for indirect or consequential loss arising from the use of this website.
This limitation does not apply where liability cannot legally be excluded or limited, including rights and remedies available under the Australian Consumer Law.
15. Changes to these Terms
We may update these Terms when our services, practices or legal obligations change. The current version will be published on this website with its updated date.
Changes apply from the date they are published and do not remove rights that arose before that date.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
17. Governing law
These Terms are governed by the laws of Australia and the laws applicable in the Australian state or territory in which Psycho-T is established.
Nothing in this section prevents a consumer from relying on any mandatory rights available under the laws that apply to them.
